Public Offer
for Ordering, Purchasing and Delivering Goods
This Agreement constitutes an official and public offer by the Seller to enter into a sales contract for goods presented on the website theukrainians.org. This Agreement is public, meaning that under Article 633 of the Civil Code of Ukraine, its terms are the same for all buyers regardless of their status (individual, legal entity or sole proprietor) and cannot give preference to one buyer over another.
By concluding this Agreement, the Buyer fully accepts all terms regarding order placement, payment, delivery, returns, liability for fraudulent orders and all other provisions. The Agreement is considered concluded once the Buyer clicks the “Confirm Order” button on the Checkout page and receives an electronic confirmation from the Seller.
1. Definitions
1.1. Public Offer (hereinafter “Offer”) — a public proposal by the Seller, addressed to an unlimited number of persons, to enter into a distance sales contract (hereinafter “Agreement”) under the terms set out in this Offer.
1.2. Goods — any item selected by the Buyer on the website of the online store and added to the Shopping Cart, or any item purchased remotely from the Seller.
1.3. Online Store — the Seller’s website at shop.theukrainians.org, created for concluding retail sales agreements online.
1.4. Buyer — a legally capable individual aged 18 or older who receives information from the Seller and places an order for personal (non-business) use or a legal entity/sole proprietor.
1.5. Seller — Sole Proprietor (ФОП) Paplauskaite Mariia Oleksandrivna, TIN 3240215807, registered under Ukrainian law, address: Ukraine, 02081, Kyiv, Prychalna Street 14, Apt. 53.
1.6. Acceptance — full and unconditional agreement of the Buyer to all terms of this Offer (confirmed by clicking “Confirm Order”).
1.7. Documents (Appendices) to the Offer — separate documents that form an integral part of this Offer:
- “Delivery and Payment”
- “Returns and Exchanges”
- “Privacy Policy”
2. Subject of the Agreement
2.1. The Seller agrees to transfer ownership of the selected Goods to the Buyer, and the Buyer agrees to pay for and accept the Goods under the terms of this Agreement.
2.2. The Agreement is considered concluded on the date the Buyer fills out the order form on the Online Store and receives an electronic confirmation from the Seller. Upon request, the Agreement may also be executed in writing.
3. Order Placement
3.1. The Buyer independently places an order through the online form on the website or, if needed, submits the order request by email or phone specified in the “Contacts” section.
3.2. The Seller may refuse to process an order if the information provided is incomplete or raises doubts regarding its accuracy.
3.3. When placing an order, the Buyer must provide:
- Last name, first name, and (if needed) patronymic;
- Delivery details (city, pick-up point, parcel locker, or full address);
- Phone number;
- Email address.
3.4. By placing an order, the Buyer confirms that they have read this Agreement as well as all accompanying Documents (“Delivery and Payment,” “Returns and Exchanges,” “Privacy Policy”).
4. Payment for Goods
4.1. Full details regarding payment methods and procedures are set out in the document “Delivery and Payment,” which forms an integral part of this Offer and applies to all Buyer orders.
5. Delivery of Goods
5.1. All delivery terms (timeframes, fees, special conditions) are defined in the document “Delivery and Payment”, which is an integral part of this Offer and has equal legal force.
6. Returns and Exchanges
6.1. Complete rules for returns and exchanges — including timeframes, conditions, procedures, and return address — are provided in the separate document “Returns and Exchanges,” which forms an integral part of this Offer.
7. Privacy Policy
7.1. The Seller processes the Buyer’s personal data in accordance with Ukrainian legislation (the Law “On Personal Data Protection” and Resolution of the Cabinet of Ministers No. 835 of 17.09.2014). All details regarding what data is collected, for what purpose, how long it is stored, and how it is protected, are set out in the “Privacy Policy,” which forms an integral part of this Offer.
7.2. Mandatory Acknowledgment: Familiarization with the Privacy Policy is required to conclude the Agreement. By clicking “Confirm Order,” the Buyer confirms they have read and understood this document.
8. Liability of the Parties
8.1. The Seller is liable, under Ukrainian law, for failure to properly fulfill the terms of the Agreement.
8.2. If the Buyer’s personal data is lost or disclosed through the Seller’s fault, the Buyer may claim compensation as provided under the Civil Code of Ukraine.
8.3. The Buyer is responsible for the accuracy of the information provided when placing an order.
9. Force Majeure
9.1. Neither party is liable for partial or complete non-performance of obligations caused by force majeure circumstances, including natural disasters, military actions, epidemics or technological accidents.
9.2. The affected party must promptly notify the other and provide supporting documents.
10. Dispute Resolution
10.1. All disputes arising from or related to this Agreement shall be resolved through negotiations.
10.2. If resolution through negotiation is impossible, disputes shall be settled in court at the Seller’s location (Kyiv).
11. Amendments to the Agreement
11.1. The Seller reserves the right to amend this Offer. The updated Offer becomes effective immediately upon publication on the Online Store website.

Returns and Exchanges
1. General Provisions
1.1. This document is an integral part of the Seller’s Public Offer Agreement and regulates the procedure, conditions, and timeframes for returning or exchanging goods purchased from shop.theukrainians.org.
1.2. Familiarization with this document is required to conclude the Agreement. Clicking “Confirm Order” means the Buyer agrees to the return and exchange terms.
1.3. Definitions:
- Goods of proper quality — unused items in intact factory packaging, with all tags, labels and seals preserved.
- Goods of improper quality — items with manufacturing or transportation defects not caused by the Buyer.
2. Returning Goods of Proper Quality
2.1. Under Article 9 of the Law of Ukraine “On Consumer Protection,” the Buyer may return goods of proper quality within 14 calendar days from receipt (excluding the date of purchase), provided that:
- The packaging is intact;
- All labels and factory seals are preserved;
- There are no signs of use;
- The product retains its commercial appearance (no scratches, stains, etc.).
2.2. Return shipping costs for goods of proper quality are paid by the Buyer.
2.3. The Seller refunds the cost of the goods only (excluding delivery fees), unless the parties agree otherwise.
2.4. Under the Cabinet of Ministers Resolution No. 172 (19.03.1994), printed publications of proper quality cannot be returned or exchanged.
If a book contains printing defects, the Seller will refund the cost of the defective item at the Buyer’s request.
3. Returning Goods of Improper Quality
3.1. If a manufacturing or transportation defect is identified, the Buyer may return or exchange the item within the manufacturer’s warranty period or within 14 calendar days from discovering the defect.
3.2. If the defect is confirmed, the Seller must:
- Exchange the item for the same product; or
- If unavailable, exchange for a product of equal value or refund the difference; or
- Refund the Buyer in full, including delivery costs.
3.3. All costs for checking, exchanging, or returning defective items (including delivery) are covered by the Seller.
3.4. International Orders:
For defective goods delivered outside Ukraine, the Seller may decide whether returning the item is reasonable (considering return shipping costs, etc.).
If return is deemed impractical, the Buyer may receive:
- a refund for the item; or
- a replacement item shipped without requiring the defective item to be sent back.
Shipping of the replacement item is covered by the Seller.
4. Return / Exchange Procedure
4.1. To begin a return or exchange, the Buyer must contact the Seller:

4.2. The request must include:
- Order number;
- Name and quantity of items being returned/exchanged;
- Reason for return (“wrong size,” “defective item,” etc.);
- Photos (required for defective goods).
4.3. The Seller responds within 4 business days with instructions for return or exchange.
